The plant is still a Class V scheduled substance.
When: January 9th, 2021
Where: Chang Rak subdistrict, Bang Saphan Noi district, Prachuap Khiri Khan province
Perpetrator: Mr. Thanapong Singsawat, 22
Victims: Those seeking relief
What: On January 9th, 2021, Prachuap Khiri Khan police, working with the Royal Thai Army, arrested Mr. Thanapong Singsawat, 22, resident of Chiang Mai, in Prachuap Khiri Khan. Authorities seized 86 kilograms of fresh kratom leaves in the bust.
Mr. Singsawat sped through a checkpoint and did not stop. Officers called for reinforcement by radio and followed his vehicle. They pulled him over and found the kratom.
The current legal status of kratom is it’s a Schedule 5 narcotic (source at bottom of article from Siam Legal). The Office of the Narcotics Control Board recently passed a resolution to allow growing kratom in 135 villages, and people can possess it there. Unrestricted use of kratom is prohibited still. The government still controls its distribution and thus the arrest for smuggling the plant.

My take: I’ve only heard good things about kratom. It is a traditional plant used in Thailand and my hunch is that as time goes on, its use will become more accepted, but the government will still regulate its growth and distribution.
Unfortunately, until that point, people still risk their freedom to get the plant to the people.
